Terms of Service
1. Agreement
These Terms of Service ("Terms") govern your use of the MaktabMate platform ("the Service") provided by MaktabMate Ltd ("we", "our", "us"), a company registered in England and Wales.
By registering for or using the Service, you ("the Customer", "you", "your maktab") agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. The Service
MaktabMate is a cloud-based school management platform designed for Islamic supplementary schools (maktabs). The Service includes student management, attendance tracking, progress tracking, staff management, parent communication, homework management, fee management, and related features.
We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of any material changes.
3. Account Registration
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials and login code.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorised use of your account.
- You must be at least 18 years old to create an account.
4. Subscription and Payment
4.1 Plans and Pricing
The Service is offered on a subscription basis. Current plans and pricing are displayed on our website. Prices may change with 30 days' notice.
4.2 Free Trial
New accounts receive a 30-day free trial. No payment is required during the trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service.
4.3 Billing
Subscription fees are billed monthly in advance via our payment processor, Stripe. All prices are in GBP and inclusive of VAT where applicable.
4.4 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
5. Your Responsibilities
As a Customer, you agree to:
- Use the Service only for its intended purpose of managing your maktab
- Ensure all data entered into the platform is accurate and lawfully collected
- Comply with the UK GDPR and Data Protection Act 2018 as a data controller
- Provide appropriate privacy notices to your students, parents, and staff
- Obtain any necessary consents for processing personal data, including children's data and special category data (religious affiliation)
- Not use the Service for any unlawful purpose
- Not attempt to access another organisation's data
- Not share login credentials with unauthorised persons
- Keep your maktab login code secure and only share it with authorised staff and parents
6. Data Protection
Our processing of personal data is governed by our Privacy Policy and Data Processing Agreement, which form part of these Terms.
You acknowledge that:
- You are the data controller for all personal data you enter into the Service
- We act as your data processor and will process data only on your documented instructions
- You are responsible for the lawfulness of data you upload to the platform
- You must respond to data subject access requests from your students, parents, and staff
7. Intellectual Property
- The Service, including its design, code, features, and documentation, is the intellectual property of MaktabMate Ltd.
- You retain ownership of all data you enter into the Service.
- We do not claim any ownership rights over your data.
- You grant us a limited licence to process your data solely for the purpose of providing the Service.
8. Availability and Support
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice.
Support is provided via email at info@maktabmate.co.uk. We aim to respond to support queries within 2 business days.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, whether express or implied.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
10. Termination
10.1 By You
You may terminate your account at any time by cancelling your subscription and contacting us at info@maktabmate.co.uk.
10.2 By Us
We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees, or use the Service in a manner that threatens the security or integrity of the platform. We will provide reasonable notice where practicable.
10.3 Effect of Termination
Upon termination:
- You may request export of your data within 30 days
- We will delete your data within 90 days of termination, in accordance with our Data Processing Agreement
- Sections relating to liability, intellectual property, and governing law survive termination
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, via email or through the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
